SpeechEasy Manufacturer's Extended Warranty
In addition to the 1-year limited manufacturer's warranty that comes standard with every SpeechEasy device, Janus Development Group now offers Extended Warranty Service Plans for your device. Our Extended Warranty Service Plans serve as extensions of your original 1-year manufacturer's limited warranty - and can be purchased in lengths of 1 or 2 additional years. This program offer is only available for purchase within the first 90 days after the device manufacture date. If your device fails for manufacturing reasons due to materials or workmanship, within the coverage period, we will repair or replace the device as necessary at no charge.
How to Enroll in the SpeechEasy Service Plan:
To begin your service plan coverage: Complete, in its entirety, and sign the order form, which can be downloaded here, indicating which of the warranty plans you would like to purchase. Separate the enrollment form from the brochure at the perforated line. Keep the remaining portion for your records. Mail this form along with your check, money order, or credit card information to:

Extended Warranty Terms and Conditions
Extended Service Terms - What Extended Service Covers and the Period of Coverage
Extended Service extends the original manufacturer's warranty on the SpeechEasy device for a period of one or two years as purchased by you. During the Extended Service period, Janus Development Group, Inc. covers your SpeechEasy device against manufacturing defects in materials and workmanship. The Extended Service period begins on the date you purchase the Extended Service or, if later, the expiration date of the original limited 1-year manufacturer's warranty that came with your purchase of your device. Due in part to customization issues, Extended Service is valid only for the original purchaser of the covered device.
Extended Service Conditions - Extended Service is subject to the following conditions:
All Extended Service must be performed by authorized service locations. Extended Service coverage is effective only if the product is purchased and used in the United States. Extended Service does not cover the cost of re-fitting or re-evaluation, except as specifically provided under "Coverage." Extended Service does not cover damage, defects, or failure caused by abuse or misuse; excessive wax accumulation; improper care; impact or insertion of foreign objects; improper fitting; vandalism; improper storage; improper or incorrectly performed maintenance or repair; application of harmful chemicals; Acts of God, fire, or water; abrasives; negligence; failure to follow manufacturer's instructions; loss of the device; normal wear and tear; or alteration.
Extended Warranty Coverage
If a device fails under a covered condition during the Extended Service period, we will repair or replace the device, at our option, at no cost to you. If we choose to replace the device, we will replace the device with the same product or another comparable product of equal or higher value. Replacement parts may be new or reconditioned of like kind and quality. If repair or replacement will take longer than fifteen (15) business days, we will notify you of an estimated repair or replacement date. We will pay reasonable shipping costs to and from your location in the United States. If we replace the entire device, including all fitted parts, we will cover the cost of re-fitting. Repaired or replaced devices are covered only for the remainder of the Extended Service period. Please see "Limitations on Liability and Exclusions" and "Disputes," below, for additional important information.
How You Make an Extended Service Claim
To file a claim, contact Janus Development Group, Inc. at the phone number or address listed below. Janus Development Group, Inc. will issue a Return Authorization number for the repair, and will issue a pre-paid shipping label for returning the device. Do not send your device without first contacting us for instructions. Claims must be accompanied by a completed Extended Service Claim Form, and filed within the Extended Service period. We may request information to verify the date you purchased the Extended Service Contract. Except for implied warranties arising under state law, or as otherwise limited by law, the time within which an action must be commenced to enforce any of our obligations arising under this contract or under any statute or law of the United States or any state thereof, is limited to ninety (90) days from the date you discover or should have discovered the defect. Extended Warranty Cancellation
You may cancel this contract at any time prior to the start of the Extended Service period and receive a full refund of the amount you paid for this contract. However, once the Extended Service period has started, you will not receive a refund if you cancel.
Limitations on Liability and Exclusions
We do not cover any services, such as fitting, evaluation, or maintenance. We disclaim and shall not be liable for any indirect, consequential, special, or incidental damages, whether in contract, tort, or otherwise, and whether or not we have been advised of the possibility of the same. Except to the extent otherwise required by law, our monetary liability for this contract shall not exceed the price you paid for this contract, and our monetary liability in connection with any device (other than covered repair or replacement) shall not exceed the price you paid for the device, excluding freight, service fees, and taxes. We are not responsible for any costs or losses you may incur because of failure of delivery, late delivery or errors in delivery, or mistakes on a Claim Form submitted by you. The sole remedy provided by this contract is the repair or replacement of defective devices. Any refunds are in our complete discretion and do not obligate us to make any future refunds. ALL WARRANTIES IMPLIED BY STATE LAW, INCLUDING (BUT NOT LIMITED TO) IMPLIED WARRANTIES OF MERCHANTIBILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE DISCLAIMED OR, IF A DISCLAIMER IS NOT PERMITTED BY LAW, ARE EXPRESSLY LIMITED TO THE DURATION OF THE COVERAGE PERIOD SET FORTH ABOVE. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. This contract gives you specific legal rights, and you may also have other rights which vary from state to state.
Disputes
This contract is governed by the laws of the State of North Carolina, without regard to principles of conflicts of laws, and applicable United States federal law. The United Nations Convention on Contracts for the International Sale of Goods shall not apply. YOU AGREE TO SUBMIT ANY CLAIM, DISPUTE, OR CONTROVERSY (REGARDLESS OF THE FORM OR TYPE OF ACTION) AGAINST US TO ARBITRATION ADMINISTERED BY THE NATIONAL ARBITRATION FORUM UNDER ITS CODE OF PROCEDURE THEN IN EFFECT (available at http://www.arb-forum.com or via telephone at 1-800-474-2371). Except to the extent otherwise required by law, you agree that the arbitration proceedings will take place exclusively in Greenville, North Carolina, USA. You may be entitled to file suit under state laws without submitting your claim to arbitration first. Information on arbitration may be obtained from, and a claim may be filed with, the National Arbitration Forum at P.O. Box 50191, Minneapolis, MN 55405-0191 USA.
Miscellaneous Terms
You are not required to purchase Extended Service to obtain the original warranty on the device or to obtain any financing. We do not finance Extended Service contracts. This contract is not intended as a warranty or insurance policy. As used in this contract, "we" and "us" refers to Janus Development Group, Inc., the U.S. manufacturer or distributor of the SpeechEasy device. "You" refers to the individual owner of a device who has purchased this Extended Service contract for that device. A waiver of strict compliance with any term herein shall not be deemed a continuing waiver or waive any other terms or conditions. Any modification or amendment to this contract must be in writing and signed by the President of Janus Development Group, Inc. in order to be effective. Distributors, dealers, and speech language pathologists are not authorized to add to or vary this contract. If any term herein is illegal, invalid, or unenforceable, then such term shall be ignored, but the remaining terms and conditions shall remain in effect. The official language of this contract is English. We are excused from performance to the extent of any delay or inability to perform arising due to weather events, disasters, acts of terror, governmental action or regulation, labor or materials shortages or disputes, or other circumstances not under our control.
